The Director General (DG) of the Ghana Police Service's Criminal Investigation Department (CID) and the DG of the unit responsible for legal and prosecution matters had bench warrants issued by the High Court of Accra for their arrest. The two had been consistently failing to show up in court to respond to charges of alleged contempt, so the arrest warrants were issued.
The ruling was made in response to an application submitted by Sureword Global Outreach, which asked the court to compel the respondents to give the applicant back the car they had seized, which had the registration number GN 2925-20.
The bench warrant was issued because the respondents regularly failed to appear in court despite the court's directions.
Attorney representing Abraham Arthur, the petitioner, asked to have the director of the Legal and Prosecution Unit and the head of the CID committed for contempt at Monday's sessions.
The court determined that the arrest warrants were issued because the respondents had "blatantly refused" to follow its instructions.
The Director General of the Ghana Police Service's Criminal Investigation Department and the Director of the Ghana Police Service's Legal and Prosecution Department were specifically ordered by the court to appear before the court on Monday morning. Although the orders were followed, the two respondents were not present in court.
The court said that there was affidavit of service proving the execution of the court's order to serve on the IGP and that there was evidence in the file to support the court's directions.
Once again, on March 26, a prior order was served on the IGP.
"This court has extended enough courtesy to these public officers and due to the fact that there is nobody above the law, I hereby issue a bench warrant for the arrest of the respondents," the judge said.
